Court Rules In FAVOR Of Free Speech Rights For Pro-Life Students

A federal appeals court unanimously ruled that the government cannot use “selective enforcement” to favor left-wing protestors, according to the Washington Stand.

The decision came after a contentious case that seemed to pit pro-life students and pro-life African Americans against the actions and ideologies of the violent mobs associated with “Black Lives Matter” movements across the U.S. During the summer of 2020, when BLM protestors destroyed businesses and public spaces, and were left to their violent devices without interference from law enforcement.

The Law Favors Free Speech

“The government may not play favorites in a public forum — permitting some messages and prohibiting others,” Judge Neomi Rao wrote of the decision to side with the pro-life students. She noted that in 2020, BLM rioters “covered streets, sidewalks, and storefronts with paint and chalk. The markings were ubiquitous and in open violation of the District’s defacement ordinance, yet none of the protesters were arrested.”

“It would undermine the First Amendment’s protections for free speech if the government could enact a content-neutral law and then discriminate against disfavored viewpoints under the cover of prosecutorial discretion,” Rao continued. “We hold the [Frederick Douglass] Foundation has plausibly alleged the District discriminated on the basis of viewpoint in the selective enforcement of its defacement ordinance.” (LEARN MORE: 32,000 Fewer Abortions Happened After Roe v. The panel ruled 3-0. Though Rao was a Trump appointee, the other judges were appointed by former President Barack Obama and President Joe Biden.
