Appeals Court Sides With Doctors On Use Of Ivermectin For COVID-19
A federal appeals court in New Orleans ruled Friday that the Food and Drug Administration seriously overstepped their legal authority when trying to mitigate a lawsuit regarding the use of ivermectin for treating COVID-19.
The decision came after ruling that three doctors were able to move forward with a lawsuit brought about over the use of ivermectin during the pandemic. “The FDA misled the public into thinking it has more authority than it does,” Dr. Bowden told the Epoch Times. “This decision confirms that the FDA is not your doctor and has no authority to tell doctors how to practice medicine.” (LEARN MORE: EPA Won’t Search For Toxins In East Palestine Because They Know They’ll Find It, Expert Says)

“The Doctors have plausibly alleged that FDA’s Posts fell on the wrong side of the line between telling about and telling to,” Judge Don Willett wrote as part of a three-person panel in the case. “FDA is not a physician. It has authority to inform, announce, and apprise—but not to endorse, denounce, or advise. The Doctors have plausibly alleged that FDA’s Posts fell on the wrong side of the line between telling about and telling to. As such, the Doctors can use the APA to assert their ultra vires claims against the Agencies and the Officials.”

Social media posts made by the FDA were cited as evidence against the administration. “Even tweet-sized doses of personalized medical advice are beyond FDA’s statutory authority,” Willett continued.
